Pedestrian & Bicycle Claims


Between 2004 and 2014, more than 46,000 pedestrians were fatally injured in the U.S. In Jacksonville alone there were 379 fatalities and, in 2016, there were more than 15,000 injury-producing pedestrian accidents here. Distracted and/or intoxicated  drivers are more often the cause. 

Under Florida law, pedestrians (and bicyclists, skateboarders) are required to comply with traffic control devices and rules, but  motorists are generally obligated to yield to them.  There are many circumstances that can affect these rules

In one case, where the police, witnesses and truck driver all blamed the pedestrian, I recovered ten times the offer made to another lawyer after finding that the driver failed to follow his company's rules and was backing with a broken back-up camera.

 

In another, I was able to prove to a Florida Jury that the driver with a green traffic light was at fault because she was likely texting and speeding at the time the pedestrian was struck.
